Terms & Conditions
1.1. Walia Adventures and its subsidiary, Sheffield Tour, and its agents act only as agents of passengers in all matters relating to hotel accommodation, transport of tour by aircraft, boat or any other means, and shall not be liable for injury, schedule change or delay, loss or damage arising from any cause and in any manner whatsoever.
1.2. Walia Adventures’/Sheffield Tour’s liability to passengers carried in its own vehicles is governed by the laws of Ethiopia, and all claims are subject to the jurisdiction of the court of Ethiopia in which the cause of action arises.
1.3. Walia Adventures/Sheffield Tour reserves the right to employ subcontractors to carry out any or all parts of the services agreed to be supplied, and in any event of the exercise of such right the terms of clause (1.2) relating to Walia Adventures’/Sheffield Tour’s liability shall apply.
1.4. While every care is taken, Walia Adventures/Sheffield Tour cannot be held responsible for loss of or damage to baggage or other personal belongings.
Good faith is the principle; hence, on confirmation of tours, agencies or individuals making bookings shall make payments as follows:
2.1. 30% upon confirmation of the tour.
2.2. The balance of 70% is payable 60 days prior to the commencement of the tour.
2.3. If complete payment has not been made as per above, Walia Adventures/Sheffield Tour is not obliged to accept the client and conduct the tour unless other arrangements have been made beforehand, and no refunds will be made.
Cancellations of tour bookings must be made in writing, and are subject to the following charges:
3.1. In the event of cancellation prior to 60 days in advance of the tour, your deposit is refundable in full less a handling fee of 10% of tour cost.
3.2. In the event of cancellation from 60 to 31 days of the tour commencement, payment
will be refunded, less the 30% deposit.
3.3. 30 days to 15 days prior to departure, a fee of 50% of the tour price will be charged.
3.4. If cancellations made within 14 days prior to departure, no refund will be made.
If a deposit has been made and refund is to follow, administrative fees like bank transfer charges will be the expenses of the client.
WALIA ADVENTURES represents and warrants that all services provided shall be performed in a professional and competent manner in accordance with the highest professional standards in WALIA ADVENTURES’ trade or industry. WALIA ADVENTURES shall promptly correct any non-conforming or defective service or product at no additional cost to CLIENT; or at CLIENT’S option, WALIA ADVENTURES shall promptly repair, replace, or refund the amount paid for such product and service provided that CLIENT has given reasonable notice to WALIA ADVENTURES staff and WALIA ADVENTURES has failed to repair or replace product or service within a reasonable time.
6. Right of Termination
CLIENT or WALIA ADVENTURES reserves the right to terminate this Agreement, by written notice to the other party at any time prior to Arrival Date, in the event one or more of the following occurs:
The parties’ performance under this WALIA ADVENTURES Contract is subject to acts of God, war, government regulation, terrorism, disaster, national strikes, national labor dispute, floods, civil disorder, pandemic outbreaks recognized by World Heath Organization, curtailment of transportation facilities, or any other emergency beyond the parties’ control making it inadvisable/impossible, illegal or which, materially affects a party’s ability to perform its obligations under this Addendum. This includes but is not limited to a travel warning imposed by the World Health Organization or the Center for Disease Control. .
5. Insurance and other Responsibility
Travel, cancellation and baggage insurance are recommended for all of our clients. The purchase and processing of insurance coverage is the responsibility of the client. Prior to starting a tour an insurance protection should be one of the major considerations for the full duration of the travel, to cover personal injury, medical expenses, and repatriation expenses. If a client falls ill, all hospital expenses, medical expenses, doctor’s fees and repatriation costs are the client’s responsibility and Walia Adventures/Sheffield Tour shall not be liable for any refund of the tour.
Quoted tour prices include planning, handling and operational charges, and are quoted based on the current rate of exchange. In the event of a marked increase in foreign exchange or tariff rates, costs are subject to revision. Walia Adventures/Sheffield Tour purchases transportation, hotel accommodations, restaurant and other services from various independent suppliers that are not subject to its control.
Walia Adventures CANNOT, THEREFORE, BE LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE that may occur due to:
1) Any act or omission of such a supplier, or
2) Defects in or failures of any aircraft, vessel, automotive vehicle or other means of transportation that is not under its control.
